Abbeville County Clerk Record Duties
The Clerk's office is the local support point for South Carolina's Circuit Court structure in Abbeville County. Common Pleas covers civil cases. General Sessions covers criminal cases. Family Court covers divorce, custody, support, juvenile, domestic, and related family matters. The office does not replace the Probate Court for estate and marriage license work, and it does not replace Magistrate or Municipal Courts for many lower-level traffic and summary matters.
- Common Pleas: accepts and maintains civil case paperwork and prepares rosters for civil terms.
- General Sessions: accepts and maintains warrants, tickets, bonds, indictments, and other criminal materials.
- Family Court: maintains cases under Court Administration requirements and handles support-payment receipt and disbursement functions.
- Jury administration: supports jury selection for court operations.
- RMC and ROD functions: handles real property recording, with research directed to the Administrative Complex.
The Abbeville County online forms source confirms that county forms are collected as PDFs in one official location.
That forms page is a useful starting point for county documents, while court-specific copies still route through the proper Clerk or court counter.
Search Abbeville County Clerk Records
Abbeville County court records can start with the South Carolina Judicial Branch case records path and the Abbeville Public Index, but the Clerk page gives important limits. It states that a person must come in person to request specific information about Child Support, General Sessions charges, or a Common Pleas case. That local instruction is stronger than a general online-search assumption.
For rosters, the Clerk page links the Abbeville County court rosters portal. The instructions are to accept the disclaimer, select a Court Agency, select a Roster Type, and choose a Begin Date. Family Court public access is through the statewide Family Court Public Portal. Attorney access is separate and requires Attorney Information System ID and password.
Record seekers should also separate a roster from a case file. A roster helps identify scheduled court activity. A Public Index entry may show a case path when the browser and portal allow access. A certified copy, support-payment detail, full Common Pleas file question, or General Sessions charge question may still require the Clerk's counter. RMC recordings are another separate path because the Clerk page sends real estate recording research to the Abbeville County Administrative Complex, Suite 2400.
The Abbeville court rosters source is the assigned image reference for Clerk roster access.
Rosters show scheduled court activity, but they are not the same as a certified case document from the Clerk of Court.
Request Certified Abbeville County Copies
Certified copies are requested when the receiving agency needs an official court copy rather than an online screen view. The research did not locate a county-specific certified-copy fee table for every Clerk document, so the copy request should begin with the correct division contact. General Sessions, Common Pleas, and Family Court records may have different access limits, and some family or juvenile information may be restricted.
- Identify the court division: Common Pleas, General Sessions, Family Court, or RMC recording.
- Gather party names, case number if known, document type, filing date or approximate year, and the number of copies needed.
- Use the online portal for basic lookup when available, but appear in person when the Clerk page requires it for specific case or support information.
- Ask the Clerk's office for the current plain-copy, certification, and payment rules before ordering.
- For county administrative records outside ordinary court access, use the Abbeville County FOIA form process.
Certified court copies should be requested from the originating court office. For estate or marriage license copies, use the Abbeville County Probate Court instead.
When the request involves a family matter, bring enough information to distinguish the case without relying on private identifiers in open email. Family Court files can include divorce, custody, support, paternity, adoption, juvenile, and domestic-abuse material. Some records may be visible only in limited form through the public portal, while other details are restricted by law, court rule, or order. The Clerk's office can route procedural copy questions, but it cannot provide legal advice about whether a document should be filed, sealed, or challenged.
Abbeville County FOIA Form Fields
The county FOIA form is a fallback for county-held administrative records that are not obtained through routine court counter access. It is not a shortcut around judicial-record rules, sealed records, child support privacy, juvenile confidentiality, or Family Court restrictions. The official form must be signed and submitted in person or by mail to the County Director at the Administrative Complex, 903 West Greenwood Street, Suite 2800, Abbeville, SC 29620. Faxed requests are not accepted.
